1) Introduction

Thank you for visiting our website, owned and operated by Digitalselves, LLC (“Digitalselves,” “we,” “us,” or “our”), the official representative and service provider for VapeMeds. These Terms & Conditions (“Terms”) are a legally binding agreement governing your use of this website and any related products, services, features, content, apps, and widgets (collectively, the “Site”), as well as any purchases you make.

By accessing the Site and/or purchasing from us, you agree to be bound by these Terms and any additional terms, policies, and notices referenced here or available by hyperlink, including our Privacy Policy and Shipping & Returns Policy. If you do not agree, do not use the Site.

All offers, information, tools, and services on the Site are provided by Digitalselves, LLC representing VapeMeds, and are conditioned on your acceptance of these Terms. If these Terms are deemed an offer, acceptance is expressly limited to them.

2) Changes to Terms

We may update, modify, or replace any part of these Terms at any time by posting changes on the Site without prior notice. Your continued use after changes post constitutes acceptance. Review this page periodically.

3) Lawful Use & Restrictions

You agree to use the Site only for lawful purposes and in compliance with all applicable laws and regulations. Except as expressly permitted in these Terms, you may not use, reproduce, distribute, reverse engineer, modify, publish, display, transmit, frame, link, rent, lease, loan, sell, license, or otherwise exploit any Site content.

4) Right to Refuse Service

We may refuse service to anyone, for any reason, at any time. Your non-payment data (e.g., credit card numbers) is not transferred unencrypted; however, other content you transmit may pass through various networks and be adapted to technical requirements. You agree not to resell or exploit any part of the Site or access to the Site without our written permission. Headings are for convenience only.

5) Personal Information & Privacy

Your submission of personal information is governed by our Privacy Policy (incorporated here by reference). Your use of the Site implies acceptance of it. There is no right of privacy as it relates to anything you provide to VapeMeds customer service via Digitalselves, whether written, emailed, telephoned, or otherwise communicated.

6) Shipping & Returns

Your orders are subject to our Shipping & Returns Policy (incorporated here by reference).

7) Eligibility

By using the Site, you represent and warrant that you: (a) are above the legal age of majority in your jurisdiction (and at least 21 years of age where required for hemp/cannabis or vape products); (b) have not been suspended or removed from the Site; (c) have no more than one active account; (d) will provide true, accurate, current, and complete information; (e) have authority to enter into these Terms; and (f) will not use the Site for illegal or unauthorized purposes or to violate any laws (including intellectual property laws). You may not transmit viruses, worms, or malicious code. A breach of these Terms results in immediate termination of access.

8) Accuracy, Completeness & Timeliness

The Site’s materials are for general information and may contain errors or omissions (including product descriptions, pricing, promotions, shipping charges, transit times, availability, or legality). We may correct errors and update information or cancel orders at any time without notice, including after you’ve submitted an order.

9) Modifications to Products, Services & Prices

Prices and offerings may change without notice. We may modify or discontinue the Site or any part of it at any time, without liability to you.

10) Products or Services

Some products/services may be available exclusively online and in limited quantities, and are subject to our Shipping & Returns Policy. We’ve attempted to display product colors accurately, but we cannot guarantee your monitor’s display. We may limit sales to any person, entity, region, or jurisdiction; limit quantities; change descriptions or pricing; and discontinue products at any time. We do not warrant that products, services, or information will meet your expectations or that errors will be corrected.

Educational Dosing Notice. Any dosing information is educational only and is not an instruction from Digitalselves or VapeMeds on how to use any product.

11) Your Account

To register, you must provide your name (or business name), email, and a password (“Account Information”). You are solely responsible for all activity under your account and for keeping your Account Information confidential. We may terminate accounts, change passwords, request additional authorization, or deny transactions to protect the Site and users. Notify us immediately of unauthorized use.

You agree not to: (a) register more than one account; (b) register for anyone else without authorization; or (c) register for an entity unless authorized to act on its behalf.

12) Billing & Order Information

We may refuse any order and limit or cancel quantities per person, entity, household, account, payment method, or address. We may contact you using the email/phone/billing address you provided. We may limit or prohibit orders we suspect are placed by unauthorized dealers, resellers, distributors, or fraud actors. Provide current, complete, accurate billing and account data, and promptly update it. See the Shipping & Returns Policy for more.

13) Customer Service

We try to respond promptly to inquiries but do not guarantee a response.

14) User Content; Comments

By posting, uploading, or submitting content (reviews, comments, ideas, suggestions, proposals, plans, or other materials) (“User Content”), you grant Digitalselves (for itself and VapeMeds) a worldwide, perpetual, irrevocable, royalty-free, fully transferable and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, perform, display, commercialize, and create derivative works from the User Content, in any media now known or later developed, without credit, notice, approval, or compensation. Subject to our Privacy Policy, User Content is non-confidential and may be visible to others.

You agree your User Content will not violate third-party rights; contain unlawful, abusive, libelous, obscene, pornographic, or medical claims; or include malware. We may monitor, edit, or remove content at our discretion but are not obligated to do so. You are solely responsible for your submissions.

15) Review of Submissions; User Conduct

We may (but are not required to) pre-screen or monitor User Content. We may remove, block, or modify content for any reason. We may access, read, preserve, and disclose information to: (i) satisfy law or governmental requests; (ii) enforce these Terms; (iii) detect/prevent fraud, security, or technical issues; (iv) respond to support; or (v) protect rights, property, or safety.

You agree not to use the Site to: (a) post unlawful, harmful, harassing, defamatory, obscene, hateful, or otherwise objectionable content; (b) infringe IP or privacy/publicity rights; (c) transmit malware/logic bombs; (d) obtain unauthorized access; (e) disrupt networks; (f) violate laws; (g) solicit criminal conduct; (h) solicit funds or advertise commercially without permission; (i) impersonate others or provide false information; (j) submit IDs or sensitive financial data of others; or (k) breach the Privacy Policy. Violations may result in termination and legal consequences.

16) Account Termination for Repeat Infringement

We may terminate accounts of repeat copyright infringers. If you believe a user is a repeat infringer, email info@vapemeds.com with sufficient details.

17) No Endorsement

User Content reflects user opinions only. We do not endorse, warrant, or guarantee User Content and are not responsible for its accuracy, legality, or quality.

18) Our Right to Use User Content

Without limiting Section 14, you represent and warrant you own/control all rights in your User Content and our use will not infringe others’ rights. You also grant each Site user a non-exclusive license to access and use your User Content as enabled by the Site.

We may use your username (and, if provided, your name, image, likeness, city/state) in connection with any use of your User Content.

19) Transmitting Materials; Technical Limits

You understand Site transmissions may traverse multiple networks and be adapted to technical requirements. We are not responsible for deletion/failure to store posts or other data. You may not harvest user data; run auto-responders; crawl/spider pages; scrape content; impose unreasonable loads; interfere with the Site; bypass access controls; or otherwise misuse the Site.

20) Product Availability

Product/service availability and descriptions may vary by location and time.

21) Auto-Refill (If Offered)

If you opt into auto-refill, recurring charges will be billed per your selected frequency until you cancel. No minimum term.

22) Orders; No Resale (Without Authorization)

Email confirmations are acknowledgments, not acceptance. We may limit quantities, require verification, or cancel orders without notice. Unless you are an approved, licensed wholesaler or distributor, you may not purchase for resale. Prices are in USD and effective only in the U.S. We may refuse/cancel orders placed at incorrect prices, even after submission/authorization.

23) Intellectual Property

All Site content (excluding User Content) — including text, images, photos, graphics, video, audio, software, logos, and other materials (“Proprietary Material”) — is owned by Digitalselves or its licensors and protected by U.S. and international IP laws. Except as permitted here or by written consent, you may not use, copy, modify, distribute, reverse engineer, decompile, disassemble, publish, display, perform, or create derivative works from the Proprietary Material.

24) Third-Party Websites, Tools & Ads

The Site may link to third-party websites, tools, and advertisements (“Linked Sites”). We do not control or endorse Linked Sites and are not responsible for their content, practices, products, or services. Use them at your own risk and review their terms and policies.

25) Optional Tools

We may provide access to third-party tools on an “as-is” basis without warranties or liability. Your use is at your discretion and subject to those providers’ terms.

26) Contests & Events

Contests will have their own rules, which you must agree to before entering. Your participation in any events (ours or others’) is at your own risk.

27) Software

If software is provided, it is licensed—not sold—subject to the accompanying license or, if none, a personal, non-exclusive, non-transferable, limited license to install and use. You may not copy, sell, rent, sublicense, reverse engineer, export contrary to law, or remove notices. We may auto-update software.

28) Prohibited Uses (Summary)

In addition to the above, you are prohibited from: unlawful use; soliciting unlawful acts; violating regulations; infringing IP; harassing or discriminating; submitting false data; transmitting malware; collecting personal data; spamming/phishing/scraping; obscene/immoral purposes; or circumventing security. Violations may result in termination.

29) Termination

We may suspend or terminate access (with or without notice) for any reason. Fees paid are non-refundable. Your obligations here survive termination. If we determine (in our sole discretion) your interactions are fraudulent, extortive, or suspicious, we may share identifiers with other companies as high-risk.

30) Jurisdictional & Legality Disclaimers (Hemp/THCa/Vape)

Age Restriction: You must be 21+ (or the higher age required by your jurisdiction) to purchase age-restricted products.
Know Your Laws: You are solely responsible for understanding and complying with your local, state, and federal laws regarding purchasing, possessing, and using hemp, THCa, cannabis-adjacent, or vapor products. Availability, shipment, and use may be restricted or prohibited in some locations. We may cancel or refuse orders to jurisdictions where we believe products are unlawful.
Hemp Statement (where applicable): Some products may be hemp-derived. Product classifications and compliance (e.g., Δ9-THC thresholds by dry weight) vary by item and jurisdiction. Review the specific product’s labeling and COA (if available) and your local laws before purchase/use.
Battery/Vapor Safety: Use only as directed. Follow device and charging instructions. Misuse may result in injury or property damage.
No Sales Where Prohibited: Any offers are void where prohibited by law.

31) Medical/FDA Disclaimer

No statements on the Site have been evaluated by the U.S. Food and Drug Administration. Products are not intended to diagnose, treat, cure, or prevent any disease. Consult a qualified healthcare professional before using any product, especially if you have a medical condition, take medications, are pregnant, nursing, or planning surgery. Use at your own risk.

32) Disclaimer of Warranties

The Site and all products/services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or uninterrupted/ error-free availability.

33) Limitation of Liability

To the maximum extent permitted by law, Digitalselves, VapeMeds, and their officers, directors, employees, agents, contractors, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, savings, data, goodwill, or replacement costs, arising from or related to your use of the Site or products, even if advised of the possibility. In jurisdictions that do not allow certain exclusions/limitations, liability is limited to the maximum extent permitted by law.

34) Indemnification

You agree to indemnify, defend, and hold harmless Digitalselves, VapeMeds, and their affiliates, officers, directors, employees, agents, contractors, licensors, service providers, and suppliers from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Site or products, or your violation of law or third-party rights.

35) Governing Law; Arbitration; No Class Actions

These Terms are governed by the laws of the State of California and applicable U.S. federal law, without regard to conflict-of-law rules. All disputes arising out of or related to these Terms or the Site shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (AAA) in Los Angeles County, California, under the Federal Arbitration Act. You waive the right to a jury trial and to participate in a class or representative action.

A printed version of these Terms and any electronically delivered notices shall be admissible in judicial or administrative proceedings to the same extent as other business documents.

37) Severability; Waiver; Entire Agreement

If any provision of these Terms is unlawful, void, or unenforceable, that portion will be enforced to the fullest extent possible and deemed severed, and the remainder will remain in effect. Our failure to enforce any right is not a waiver. These Terms, together with policies referenced or linked here (including the Privacy Policy and Shipping & Returns Policy), constitute the entire agreement between you and Digitalselves/VapeMeds and supersede all prior communications.
